Waste Collection Kingston Terms and Conditions
These Terms and Conditions set out the basis on which Waste Collection Kingston provides waste collection and related services. By placing a booking, you agree to be bound by these Terms and Conditions. Please read them carefully before using our services.
1. Definitions
In these Terms and Conditions, the following expressions shall have the meanings set out below:
1.1 Customer means any individual, business, organisation or other party that requests or uses our waste collection services.
1.2 Services means any waste collection, removal, transport, clearance, recycling or disposal service supplied by Waste Collection Kingston.
1.3 Waste means any materials, rubbish, refuse, junk, furniture, appliances, garden waste, commercial waste or other items presented for collection under the Services, but excluding prohibited or hazardous items as defined in these terms or under applicable law.
1.4 Agreement means the contract between Waste Collection Kingston and the Customer for the provision of Services, comprising these Terms and Conditions and the details confirmed in the booking.
2. Scope of Services
2.1 Waste Collection Kingston provides waste collection and related services within designated service areas. The precise nature of the Services, including the type and quantity of Waste to be collected, will be agreed at the time of booking.
2.2 We reserve the right to refuse to collect any items that we reasonably consider to be unsafe, unlawful, incorrectly described, excessively heavy or otherwise unsuitable for collection with the equipment and personnel available on the day.
2.3 Our Services do not include cleaning, dismantling of fixtures that are permanently attached to a building, or any form of building work. Minor disassembly of furniture or appliances may be carried out at our discretion, subject to safety and practicality.
3. Booking Process
3.1 Bookings may be made by telephone, email or other communication channels that we make available. A booking is not confirmed until we have acknowledged it and provided a booking reference or written confirmation.
3.2 The Customer is responsible for providing accurate and complete information when making a booking, including:
a) Full name, contact details and collection address.
b) Access details, parking arrangements and any restrictions that may affect the collection.
c) A clear description of the type, approximate quantity and condition of the Waste to be collected.
3.3 Estimates of volume or weight given during the booking process are based on the information supplied by the Customer. If, on arrival, the Waste materially differs in quantity, nature or accessibility from the description provided, we may adjust the price, amend the scope of work or refuse the collection in full or in part.
3.4 Any time or date for attendance provided at the time of booking is an estimate only. We will use reasonable efforts to arrive within any agreed time window but do not accept liability for delays caused by traffic, weather, operational issues or other matters beyond our reasonable control.
4. Access and Customer Responsibilities
4.1 The Customer shall ensure that our vehicles have safe and lawful access to the collection address, including suitable parking or loading space during the agreed attendance time.
4.2 The Customer must ensure that the Waste is safely accessible, not blocked by other items, and not located in areas that present unreasonable safety risks, such as unstable structures, unsafe stairways, or confined spaces without ventilation.
4.3 Where access is through communal areas, shared spaces or third-party property, the Customer is responsible for obtaining any consents that may be required and for ensuring that access is lawful.
4.4 The Customer agrees not to present for collection any materials that are prohibited under these Terms and Conditions or under applicable waste regulations.
5. Pricing and Quotations
5.1 Prices may be based on estimated volume, weight, labour time, type of Waste or a combination of these factors. A guideline quotation may be given in advance and confirmed or adjusted once our team has inspected the Waste on site.
5.2 Where we provide a quotation based on photographs, descriptions or other information supplied by the Customer, that quotation is conditional on the accuracy and completeness of that information.
5.3 All prices are quoted in pounds sterling and, where applicable, include value added tax at the prevailing rate, unless stated otherwise at the time of booking.
5.4 We reserve the right to change our standard rates and charges at any time. Changes will not affect confirmed bookings that have already been accepted, unless the scope of work is subsequently amended.
6. Payments and Invoicing
6.1 Payment is due on completion of the collection unless alternative arrangements have been agreed in writing in advance.
6.2 We may accept payment by cash, debit card, credit card, bank transfer or other methods notified to the Customer from time to time. Payment methods may vary depending on whether the Customer is an individual consumer or a business account holder.
6.3 For business Customers with approved accounts, payment shall be made within the credit terms agreed in writing. If no specific terms are agreed, payment is due within 14 days of the invoice date.
6.4 If the Customer fails to pay any amount due, we may charge interest on the overdue sum at the statutory rate applicable to commercial debts, accruing from the due date until the date of actual payment, whether before or after judgment.
6.5 We reserve the right to withhold or cancel Services, or to decline future bookings, where sums due remain unpaid.
7. Cancellations and Amendments
7.1 The Customer may cancel or amend a booking by giving notice by telephone or email.
7.2 If the Customer cancels more than 24 hours before the scheduled arrival time, no cancellation charge will normally apply, save for any non-refundable third-party charges already incurred, which will be notified to the Customer.
7.3 If the Customer cancels within 24 hours of the scheduled arrival time, or if our team attends the site and is unable to carry out the collection for reasons within the Customer's control, we may charge a reasonable call-out or late cancellation fee to cover our costs.
7.4 Any amendment to the date, time, address or scope of the Services is subject to our availability and agreement. Changes that materially affect the nature or scale of the collection may result in revised pricing.
7.5 We reserve the right to cancel a booking at any time if:
a) The information provided by the Customer is materially inaccurate or incomplete.
b) Access to the site is unsafe, unlawful or impracticable.
c) The Waste includes prohibited or hazardous materials for which we are not licensed or equipped.
d) Events outside our reasonable control prevent us from attending. In such cases, we will offer to reschedule where possible and appropriate, but we shall not be liable for any indirect losses resulting from the cancellation.
8. Waste Types and Prohibited Materials
8.1 Waste Collection Kingston operates in accordance with applicable UK waste management and environmental regulations. All Waste is transported and disposed of via authorised facilities as required by law.
8.2 The Customer must not present for collection any of the following without our prior written agreement and, where relevant, the provision of necessary documentation:
a) Hazardous or special waste such as chemicals, solvents, asbestos, clinical waste, sharps, medical waste, oils, paints, gas cylinders, pesticides or flammable substances.
b) Electrical items containing refrigerant gases or substances that require specialist treatment, unless expressly agreed.
c) Explosive, radioactive, toxic or corrosive materials.
d) Any materials for which the Customer does not have lawful ownership or the right to dispose.
8.3 We reserve the right to refuse any items that, in our judgment, may breach waste regulations, pose a risk to health and safety, or require permits or licences that are not in place.
8.4 Where prohibited materials are discovered after collection, we may return them to the Customer, charge additional fees for lawful handling and disposal, and report any apparent regulatory breaches to the relevant authorities where we are legally obliged to do so.
9. Title, Risk and Environmental Compliance
9.1 Upon collection of Waste and receipt of payment where applicable, title to the Waste transferred for removal passes to Waste Collection Kingston, subject to any statutory or regulatory requirements.
9.2 Risk in the Waste passes to us once it is loaded onto our vehicles, except where prohibited or undeclared hazardous materials are discovered, in which case risk may revert to the Customer as permitted by law.
9.3 Waste Collection Kingston is committed to lawful and environmentally responsible waste management, including recycling and recovery where feasible. However, we do not guarantee that all Waste will be recycled, as disposal routes are subject to material type, condition and prevailing regulations.
10. Liability and Limitations
10.1 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter for which liability cannot be lawfully excluded or limited.
10.2 Subject to clause 10.1, we shall not be liable for:
a) Indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity, or damage to goodwill.
b) Loss or damage arising from inaccurate information provided by the Customer.
c) Loss or damage to items that the Customer has left inside furniture, appliances or containers presented for collection.
10.3 While we will take reasonable care when carrying out the Services, the Customer is responsible for protecting floors, walls, fixtures and fittings where heavy or bulky items must be removed through tight or awkward spaces. Minor scuffs or marks that may reasonably arise from the normal performance of bulky waste removal shall not be considered our negligence.
10.4 If we are found liable for damage to property arising from our negligence, our total liability shall, so far as permitted by law, be limited to the lesser of:
a) The reasonable cost of repair or replacement of the damaged property, or
b) The total price paid or payable by the Customer for the relevant Services.
10.5 The Customer shall notify us in writing of any claim for loss or damage as soon as reasonably practicable and, in any event, within 7 days of becoming aware of the issue. We may require evidence, including photographs, receipts or independent assessments.
11. Customer Conduct and Health and Safety
11.1 The Customer agrees to cooperate with our team and to follow any reasonable instructions given in relation to health and safety during the collection.
11.2 We reserve the right to withdraw our staff from any site where they feel threatened, unsafe or subject to abusive behaviour. In such circumstances, we may treat the booking as cancelled by the Customer and apply appropriate cancellation charges.
11.3 The Customer must not ask our staff to undertake tasks that are outside the agreed Services, are unsafe, or could breach regulatory requirements. Any such requests may be refused without liability.
12. Data Protection and Privacy
12.1 We may collect and process personal data relating to the Customer for the purposes of managing bookings, delivering Services, handling payments, and complying with legal obligations.
12.2 Personal data will be handled in accordance with applicable data protection laws. We take reasonable measures to protect personal information against unauthorised access, use or disclosure.
12.3 By using our Services, the Customer consents to the use of their personal data for the purposes outlined in this clause, including communication about bookings, invoices and service updates.
13. Complaints and Dispute Resolution
13.1 If the Customer is dissatisfied with any aspect of the Services, they should contact us as soon as possible, providing full details of the issue and any supporting information.
13.2 We will investigate complaints in a fair and timely manner and, where appropriate, offer corrective action, a partial refund, a re-visit or another form of resolution at our discretion.
13.3 If a dispute cannot be resolved directly, either party may pursue their rights through the courts or other dispute resolution mechanisms available under UK law.
14. Variations to These Terms
14.1 We may update or amend these Terms and Conditions from time to time. The latest version will apply to new bookings made after the date of publication of the revised terms.
14.2 Any variation to these Terms and Conditions for a specific booking shall only be effective if agreed in writing by an authorised representative of Waste Collection Kingston.
15. Severability
15.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them, their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
By placing a booking with Waste Collection Kingston, the Customer confirms that they have read, understood and agreed to these Terms and Conditions.
